We process your personal data under the following legal bases as defined by the EU General Data Protection Regulation (GDPR):

  • -Art. 6(1)(b) GDPR — Contract Performance: Processing necessary for the performance of a contract to which you are party, or to take steps at your request prior to entering into a contract.
  • -Art. 6(1)(f) GDPR — Legitimate Interest: Processing necessary for our legitimate interests including website operation, service improvement, fraud prevention, and security monitoring, provided such interests are not overridden by your fundamental rights.
  • -Art. 6(1)(a) GDPR — Consent: Where we rely on consent (e.g., for non-essential cookies or marketing), you may withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal.

4. Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected:

  • -Project-related data: Retained for the duration of the project engagement plus 36 months for legal and warranty obligations.
  • -Server logs: Retained for a maximum of 12 months for security and diagnostic purposes.

5. Data Transfers

Your data is primarily processed within the European Economic Area (EEA). Where data is transferred outside the EEA, we ensure adequate protection through Standard Contractual Clauses (SCCs) adopted by the European Commission, or other appropriate safeguards under Art. 46 GDPR.

6. Your Rights Under GDPR

You have the following rights regarding your personal data:

  • -Right of Access (Art. 15): Request a copy of the personal data we hold about you.
  • -Right to Rectification (Art. 16): Request correction of inaccurate or incomplete personal data.
  • -Right to Erasure (Art. 17): Request deletion of your personal data where there is no compelling reason for continued processing.
  • -Right to Restriction (Art. 18): Request restriction of processing in certain circumstances.
  • -Right to Data Portability (Art. 20): Receive your personal data in a structured, commonly used, machine-readable format.
  • -Right to Object (Art. 21): Object to processing based on legitimate interests, including direct marketing.

Cookies Policy

1. What Are Cookies

Cookies are small text files placed on your device when you visit a website. They are widely used to enable functionality, improve user experience, and provide analytical information to operators.

2. How We Use Cookies

bluevectorcurrent uses cookies solely for essential website functionality. We do NOT use advertising, tracking, or analytics cookies that profile users across websites. Our usage is limited to:

  • -Strictly Necessary Cookies: Required for website functionality including session cookies for form submissions and security tokens to protect against CSRF. These do not require consent under Art. 5(3) ePrivacy Directive.
  • -Functional Cookies: Optional cookies remembering preferences (language, UI customizations). Only set with explicit consent.

3. Third-Party Services

Our website may load resources from third-party services (e.g., Google Fonts, Tailwind CSS CDN). These services may set their own cookies per their privacy policies. We do not control third-party cookies.

Refund Policy

1. General Policy

bluevectorcurrent provides custom web development and creative digital services. Due to the bespoke nature of our work, refund eligibility is assessed individually based on project milestones completed and work delivered.

2. Milestone-Based Refunds

Projects are structured around defined milestones. If a project is cancelled before a milestone is completed, you are entitled to a refund for payments made for that incomplete milestone. Completed milestones are non-refundable.

  • -Pre-Project Cancellation: Full refund of any advance payment within 14 business days if cancelled before development work begins.
  • -Mid-Project Cancellation: Refunds calculated based on the percentage of the current milestone completed. Payments for delivered milestones retained.
  • -Post-Delivery Disputes: If deliverables materially deviate from agreed specifications, notify us within 14 days of delivery. We will rectify issues at no additional cost or negotiate a proportional refund.

3. Non-Refundable Items

  • -Work that has been delivered and approved
  • -Third-party costs incurred on your behalf (hosting, domains, software licenses, API subscriptions)
  • -Change requests initiated after original scope agreement

4. Refund Process

Contact us at [email protected] with your project reference, reason for the request, and supporting documentation. We acknowledge receipt within 3 business days and provide resolution within 14 business days.

5. Statutory Rights

This policy does not affect your statutory rights under EU consumer protection legislation, including the 14-day withdrawal right for distance contracts where applicable (Art. 9, EU Consumer Rights Directive 2011/83/EU).

Terms of Service

1. Agreement to Terms

By engaging bluevectorcurrent for services, you agree to these Terms. These terms constitute a legally binding agreement between you ("Client") and bluevectorcurrent ("Provider"), registered at 50374 ERFTSTADT CONCORDIASRASSE 21, Germany.

2. Scope of Services

Services are defined in the project proposal or statement of work (SOW) agreed upon by both parties. The SOW specifies deliverables, timelines, pricing, and acceptance criteria. Work outside agreed scope requires a separate change order with mutual written consent.

3. Client Obligations

  • -Provide timely access to necessary systems, credentials, content, and feedback.
  • -Designate a primary contact with decision-making authority for approvals.
  • -Review and provide feedback on deliverables within 7 business days of submission.
  • -Ensure provided materials do not infringe third-party intellectual property rights.

4. Payment Terms

  • -Invoices issued per the milestone schedule in the SOW.
  • -Payment due within 14 days of invoice date unless otherwise specified.
  • -Late payments incur statutory interest of 9 percentage points above ECB base rate per Art. 3 Directive 2011/7/EU.
  • -All prices exclude VAT, applied where required by applicable tax law.

5. Intellectual Property

Upon full payment, all deliverables and associated intellectual property rights transfer to the Client. bluevectorcurrent retains the right to use anonymized project details for portfolio purposes unless the Client explicitly requests confidentiality. Pre-existing code libraries and frameworks remain the property of bluevectorcurrent and are licensed for perpetual use in the delivered project.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information exchanged during the engagement. This obligation survives termination for 36 months. Confidential information includes business strategies, technical specifications, source code, user data, and financial information.

7. Limitation of Liability

bluevectorcurrent's total aggregate liability shall not exceed the total fees paid for the specific project giving rise to the claim. bluevectorcurrent shall not be liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply to gross negligence, willful misconduct, or data protection breaches.

8. Data Protection

Both parties shall comply with the EU General Data Protection Regulation (GDPR) and applicable national data protection legislation. Where bluevectorcurrent processes personal data on behalf of the Client, a separate Data Processing Agreement (DPA) shall be executed per Art. 28 GDPR.

9. Termination

Either party may terminate with 14 days' written notice. Upon termination, the Client pays for all work completed to that date. Material breaches uncured for 30 days after written notice entitle immediate termination.

10. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany. Disputes shall first be resolved through good-faith negotiation for 30 days, then submitted to the competent courts in Cologne, Germany, unless mandatory consumer protection provisions apply alternative jurisdiction.

11. Severability

If any provision is found invalid, the remaining provisions continue in full force. The invalid provision shall be modified to the minimum extent necessary to preserve its original intent.
